The allegation was about a September 17, 2019 Instagram video where Cardone said that investors can garner a "$220,000 investment could net a $660,000 position in one of the funds, and could also earn about $12,000 to $15,000," through further distributions. In addition, it was also said that Cardone didn't pay the monthly income in April and May 20, at the beginning of the Covid-19 pandemic.

The claim was dismissed by Judge Walter because the Offering Circulars that were given to investors clearly stated: "The timing and amount of distributions are the sole discretion of our manager." In addition, the payback of debt in acquired properties was already declared as the duty of investors and Cardone as per the Official Circulars and Cardone's social media posts which made Pino's alleged blame regarding the debt solely being Cardone's to be borne a void claim.

Furthermore, the monthly payments to the investors resumed from June 2020 and Pino had received 3X more than the normal reimbursement to make up for the delay.
